TERMS AND CONDITIONS FOR GRAPHIC DESIGN SUBSCRIPTION SERVICE Last updated: June 30, 2025 1. Acceptance of Terms By subscribing to and using our graphic design services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please refrain from using our services. 2. Service Description We provide non-animated graphic design services through a monthly subscription model, with two available plans: • Basic Plan: $1,995 per month • Plus Plan: $2,995 per month Payments are processed through PayPal. Once payment is confirmed, you will receive an email with a link to a Tally form to submit your first request. After completing the form, you will receive another email with a Trello link to track the progress of your project. 3. Workflow 3.1. Design Requests Once you submit your form, your request will be added to our Trello management board, where you can track the progress. 3.2. Turnaround Times • Delivery Time: All projects are delivered within three (3) business days after a complete request is submitted. • File Formats: Final designs are delivered in various digital formats according to the client’s needs. 3.3. Revisions • Basic Plan: One (1) revision is allowed after 24 hours from the initial request. • Plus Plan: Up to two (2) revision rounds per request. 3.4. Simultaneous Requests • Basic Plan: One (1) active request at a time. • Plus Plan: Up to two (2) active requests simultaneously. 4. Pauses and Cancellations 4.1. Pauses (Plus Plan Only) You may pause your subscription at any time. While paused, you will not be charged, and the remaining days of your subscription will be preserved and available to use when resumed. 4.2. Cancellations You can cancel your subscription at any time. The service will remain active for the remainder of the 30-day billing cycle. 5. Refund Policy No refunds will be issued for completed payments. The only exception is the ability to pause your subscription if you are on the Plus Plan. 6. Intellectual Property All final designs are fully owned by the client once payment has been made. We reserve the right to showcase any completed work in our portfolio, unless the client explicitly requests otherwise in writing. 7. Limitation of Liability We are not liable for indirect, incidental, or consequential damages resulting from the use of our services. Our total liability is limited to the subscription fee paid for the current month. 8. Disclaimer of Warranties Our service is provided “as is” and “as available.” We do not guarantee uninterrupted access, error-free performance, or specific outcomes. 9. Acceptable Use You agree not to use any delivered designs for illegal, defamatory, discriminatory, or infringing purposes. We reserve the right to reject any request that violates our ethical or legal standards. 10. Indemnification You agree to indemnify and hold harmless Clay Monster, its employees, and affiliates from any claims, damages, liabilities, or expenses (including legal fees) arising from your misuse of the service or violation of these terms. 11. Force Majeure We shall not be held liable for any delay or failure to perform due to causes beyond our reasonable control, including but not limited to natural disasters, power outages, pandemics, strikes, or service failures by third parties. 12. Governing Law and Jurisdiction These Terms and Conditions shall be governed by and interpreted in accordance with the laws of El Salvador. Any disputes shall be resolved in the competent courts of El Salvador. 13. Severability If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. 14.
